Defects Reported to the FDA

Essure is a non-surgical implant that was created by Conceptus, Inc. in 2002, when it was first submitted to the U.S. Food and Drug Administration (FDA) for approval. In 2013, Bayer bought Conceptus and merged with the company.

Essure is made of metallic coils implanted into the fallopian tubes. Once in place, scar tissue forms in and around the device, blocking the fallopian tubes and preventing pregnancy.

Shortly after Bayer released Essure into the market, physicians began submitting reports to the FDA about their patients who were suffering serious complications from the device, including:

  • Persistent pain
  • Perforation of the uterus and/or fallopian tubes
  • Device migration
  • Abnormal bleeding
  • Device breakage
  • Difficult or painful intercourse
  • Heavier/irregular menstruation
  • Fatigue
  • Weight fluctuations
  • Allergy or hypersensitivity reactions

Patients with a nickel allergy have reported dry patches of skin and rashes forming in areas before severe symptoms occur.

In rare cases, some patients have also reported device failure, resulting in unintended pregnancies.

If you have experienced any pain or allergic reaction to Essure or became pregnant after the device was implanted, you may be able to take legal action through an Essure lawsuit with our defective medical device lawyers.

FDA Actions Against Essure

In September 2015, the FDA convened an advisory committee meeting to discuss the safety and efficacy of Essure after receiving reports of thousands of adverse event reports about the device.

After months of review, the FDA ordered Bayer to conduct a postmarket study to gather more data on the benefits and risks of the device and mandated that stronger warnings be added to the device’s label.

In November 2016, the new label was approved by the FDA to include a black box warning, the FDA’s strongest warning, about the risks of organ perforation, device migration, pain, allergic reactions and other possible adverse events. It also included a patient checklist that reviews the possible risks of the device.

Pharmaceutical companies that falsely market dangerous products to consumers as safe should be held accountable for their breach of the public’s trust. Contact our class action attorneys to learn more about filing an Essure lawsuit.
